1.4. Room Detection and AI Processing<\/strong><\/h2>\n\n\n\n

1.4.1. Categories of data processed<\/strong><\/h3>\n\n\n\n

In order to operate certain features of the uplan platform \u2013 particularly automatic room detection \u2013 the application processes the floor plans, images, and technical metadata uploaded by the user (such as walls, openings, and room contours generated during processing).<\/p>\n\n\n\n

These files typically do not contain personal data. However, if the user uploads a file that includes personal information (such as an address, name embedded in the file name, or text displayed on the drawing), this data may also be transferred for processing.<\/p>\n\n\n\n

1.4.2. Purpose of processing<\/strong><\/h3>\n\n\n\n

The data is processed for the following purposes:<\/p>\n\n\n\n

a) to analyse and recognise rooms and structures on the uploaded floor plan, enabling the automatic room detection feature;<\/p>\n\n\n\n

b) to improve the accuracy and performance of our artificial intelligence models, including the training and enhancement of recognition algorithms.<\/p>\n\n\n\n

1.4.3. Transfer of data to a third-party processor<\/strong><\/h3>\n\n\n\n

For room detection and related AI processing, the Data controller uses the following external technology provider acting as a Data processor:<\/p>\n\n\n\n

Uploaded floor plans and associated metadata may be transferred to Tectly UG via an encrypted API connection<\/strong>, strictly for the purposes described above.<\/p>\n\n\n\n

Tectly UG may only process the data to:<\/p>\n\n\n\n

\u2013 operate the room detection feature; or<\/p>\n\n\n\n

\u2013 improve the underlying recognition models.<\/p>\n\n\n\n

The processor is not permitted to use the data for any independent purpose or to transmit it to additional third parties.<\/p>\n\n\n\n

1.4.4. Legal basis of processing<\/strong><\/h3>\n\n\n\n

The legal basis for processing personal data to operate the room detection feature is Article 6(1)(b) GDPR<\/strong> \u2013 processing necessary for the performance of the service requested by the Data subject.<\/p>\n\n\n\n

For model-improvement purposes:<\/p>\n\n\n\n

\u2013 If the data is anonymised<\/strong>: the processing falls outside the scope of GDPR.<\/p>\n\n\n\n

\u2013 If personal data remains<\/strong>: the processing is based on the Data controller\u2019s legitimate interest<\/strong> under Article 6(1)(f) GDPR to improve the reliability and performance of its technology. The Data subject has the right to object at any time.<\/p>\n\n\n\n

Where appropriate, explicit consent may be requested instead.<\/p>\n\n\n\n

The Data subject may disable participation in model-improvement processing via account settings or through the notice displayed when using the room detection feature for the first time.<\/p>\n\n\n\n

1.4.5. Data retention<\/strong><\/h3>\n\n\n\n

Data transferred to Tectly UG is retained:<\/p>\n\n\n\n

\u2013 for primary room-detection processing: only for the duration necessary to perform the detection;<\/p>\n\n\n\n

\u2013 for model-training purposes: only for the minimum required period, after which it is deleted or irreversibly anonymised.<\/p>\n\n\n\n

1.4.6. Data security<\/strong><\/h3>\n\n\n\n

During all processing operations, the Data controller and Tectly UG apply industry-standard encryption and security measures.<\/p>\n\n\n\n

If any transfer of data occurs outside the EEA, appropriate safeguards such as Standard Contractual Clauses are applied in accordance with GDPR requirements.<\/p>\n\n\n\n

2. Introductory provisions<\/strong><\/p>\n\n\n\n

2.1 The purpose of this notice is to provide clear, up-to-date and transparent information about the<\/p>\n\n\n\n

processing of personal data in the course of the services provided by this website. This notice may be<\/p>\n\n\n\n

amended and\/or withdrawn unilaterally by the Data controller at any time, with simultaneous notification<\/p>\n\n\n\n

of the Data subjects. The information will be provided on the website.<\/p>\n\n\n\n

2.2 Further purpose of this notice is to set out the data protection and data management principles and the<\/p>\n\n\n\n

data protection and data management policy of LoxTrade Kft. and to comply with the information<\/p>\n\n\n\n

obligation pursuant to Articles 13-14 of Regulation (EU) 2016\/679 of the European Parliament and of the<\/p>\n\n\n\n

Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal<\/p>\n\n\n\n

data and on the free movement of such data, and repealing Directive 95\/46\/EC (hereinafter referred to as<\/p>\n\n\n\n

„GDPR“).<\/p>\n\n\n\n

2.3. The data protection terms that are used in this notice are defined in Article 4 of the GDPR, as well as<\/p>\n\n\n\n

supplemented by Act CXII of 2011 on the right to informational self-determination and on the freedom of<\/p>\n\n\n\n

information (hereinafter: \u201cInfo. Act\u201d). This Data management notice applies to all natural persons (Data<\/p>\n\n\n\n

subjects) whose personal data is managed by the Data controller, if the data management is related to the<\/p>\n\n\n\n

performance of the activities specified in this Data management notice.<\/p>\n\n\n\n

3. Detailed information on the circumstances of data management<\/strong><\/p>\n\n\n\n

3.1. <\/strong>Shopping on the website<\/strong><\/p>\n\n\n\n

3.1.1. You can use the services of the Website only by registering<\/strong>. In this context, we process your<\/p>\n\n\n\n

personal data as follows:<\/p>\n\n\n\n

Scope of processed personal data: surname and first name, residential address, e-mail address and other<\/p>\n\n\n\n

personal data provided by you.<\/p>\n\n\n\n

The purpose of data management: to identify you, to create and fulfill a purchase agreement between you<\/p>\n\n\n\n

and the Data controller.<\/p>\n\n\n\n

Legal basis for data management: creation and fulfillment of an agreement (GDPR Article 6 (1) point b)).<\/p>\n\n\n\n

Duration of data management: for the time necessary to fulfill the purchase agreement between you and<\/p>\n\n\n\n

the Data controller, up to the statute of limitations for civil claims (5 years).<\/p>\n\n\n\n

The Data controller does not verify the authenticity or accuracy of the personal data you provide (e.g. e-<\/p>\n\n\n\n

mail address, etc.). Only the person who provided the data is responsible for its accuracy. The Data<\/p>\n\n\n\n

controller excludes any liability arising from the incorrectness of the data.<\/p>\n\n\n\n

Provision of telephone number:<\/p>\n\n\n\n

Purpose of data management: Although the telephone number is not a condition for the fulfillment of the<\/p>\n\n\n\n

purchase agreement, as personal data, it would be difficult to solve any problems related to the order in<\/p>\n\n\n\n

the absence of the telephone number. In the event you have ordered the service and paid the purchase<\/p>\n\n\n\n

price, but there is a problem with the service for some reason, it is necessary to ensure that you are<\/p>\n\n\n\n

informed by telephone about the solution and the procedure to overcome the problem.<\/p>\n\n\n\n

Legal basis for processing: voluntary consent of the Data subject (Article 6(1)(a) of the GDPR).<\/p>\n\n\n\n

Duration of processing: for the time necessary to fulfill the purchase agreement between you and the Data<\/p>\n\n\n\n

controller, up to the statute of limitations for civil claims (5 years). The Data controller shall have primary<\/p>\n\n\n\n

access to the personal data processed for the purposes of the purchase.<\/p>\n\n\n\n

Data subject rights: in addition to the data subject rights set out in point 11 of the Data management<\/p>\n\n\n\n

notice, the Data subject has the right to withdraw his consent to the processing of his personal data at any<\/p>\n\n\n\n

time; in this case, the Data controller will no longer process his personal data and will delete the personal<\/p>\n\n\n\n

data processed on this legal basis, unless another legal basis allows for the processing of such data. The<\/p>\n\n\n\n

withdrawal shall not affect the lawfulness of the processing carried out on the basis of the consent prior to<\/p>\n\n\n\n

We use external service providers to fulfill orders:<\/p>\n\n\n\n

Credit card payment: In case of payment by card, the data of the bank card and the card payment<\/p>\n\n\n\n

transaction are managed by Stripe. In case of payment by bank card, the payer’s ID, the amount, date and<\/p>\n\n\n\n

time of the transaction are transmitted.<\/p>\n\n\n\n

Legal basis for data transfer: data management is necessary for the performance of the agreement [Article<\/p>\n\n\n\n

3.1.2. Personal data processed for the purpose of paying the consideration for the ordered<\/strong><\/p>\n\n\n\n

You can pay for the products\/services ordered on the Website by choosing from the following payment<\/p>\n\n\n\n

methods: bank transfer, bank card payment through the Stripe system.<\/p>\n\n\n\n

a)Bank transfer: in the case of a bank transfer, you can settle the consideration for the ordered<\/p>\n\n\n\n

product\/service with the help of your bank. In this case, the Data controller only processes<\/p>\n\n\n\n

personal data in connection with the crediting of the transferred amount to the Data controller’s<\/p>\n\n\n\n

account at Raiffeisen Bank.<\/p>\n\n\n\n

Purpose of data management: to identify you, to create and fulfill a purchase agreement between you and<\/p>\n\n\n\n

the Data controller.<\/p>\n\n\n\n

Legal basis for data management: execution of an agreement (Article 6 (1) b) of GDPR).<\/p>\n\n\n\n

Duration of data processing: 8 years in order to fulfill the obligation to preserve accounting documents<\/p>\n\n\n\n

(Article 169 (2) of the Act C of 2000 on accounting).<\/p>\n\n\n\n

In the case of bank transfers, access to the personal data processed is primarily granted to the Data<\/p>\n\n\n\n

controller or the Data controller’s bank.<\/p>\n\n\n\n

b)Payment by bank card: According to point 3.1.1 of the Data management notice<\/p>\n\n\n\n

Regarding payment by bank card, please note that the use of the ordered product\/service is based on a<\/p>\n\n\n\n

monthly subscription, which will be automatically deducted from your bank account each month until you<\/p>\n\n\n\n

manually cancel it in your profile settings. If the deduction was unsuccessful, Stripe will try the payment<\/p>\n\n\n\n

three times on different days, or you can manually initiate the payment in your profile settings.<\/p>\n\n\n\n

3.2. Personal data processed for the purpose of providing information relating to a purchase<\/strong><\/p>\n\n\n\n

Contact and communication between the Data controller and you are essential for the operation of the<\/p>\n\n\n\n

Website. You will receive confirmation of the purchase in the form of an electronic mail. In some cases,<\/p>\n\n\n\n

the Data controller sends notification to the Data subjects via e-mail about the products or services, as<\/p>\n\n\n\n

well as changes to the General Terms and Conditions. However, the Data controller does not use such<\/p>\n\n\n\n

notifications for advertising purposes.<\/p>\n\n\n\n

4. Processing personal data <\/strong>due to <\/strong>accounting obligations<\/strong><\/p>\n\n\n\n

According to section 2 of Act C of 2000 on Accounting the Data controller is obliged to retain the<\/p>\n\n\n\n

accounting documents underlying the accounting records directly or indirectly (including ledger accounts,<\/p>\n\n\n\n

analytical records and registers) in a legible form and in a retrievable manner for 8 years. To this end, we<\/p>\n\n\n\n

process your personal data as follows:<\/p>\n\n\n\n

Range of processed data: first and last name, home address.<\/p>\n\n\n\n

Purpose of data management: fulfillment of the obligation to retain the accounting documents underlying<\/p>\n\n\n\n

the accounting records directly or indirectly, as defined in the Accounting Act<\/p>\n\n\n\n

Legal basis for data management: fulfillment of the legal obligation of the Data controller (Article 6 (1) c)<\/p>\n\n\n\n

of GDPR).<\/p>\n\n\n\n

Duration of data processing: 8 years in order to fulfill the obligation to preserve accounting documents<\/p>\n\n\n\n

(Article 169 (2) of the Act C of 2000 on Accounting).<\/p>\n\n\n\n

The personal data processed for the purpose of fulfilling the obligation to retain the accounting documents<\/p>\n\n\n\n

underlying the accounting records directly or indirectly as defined in the Accounting Act may be accessed<\/p>\n\n\n\n

primarily by the Data controller, by K\u00f6nyvel\u00e9smegold\u00e1s.hu Kft. as the accountant, and by the operator in<\/p>\n\n\n\n

connection with the operation of the electronic invoicing system.<\/p>\n\n\n\n

5. Handling complaints<\/strong><\/p>\n\n\n\n

If you are not satisfied with the ordered product\/service or if you have any other complaint regarding the<\/p>\n\n\n\n

website, the Data controller shall provide you with the opportunity to file a complaint pursuant to section<\/p>\n\n\n\n

17\/A-17\/C of the Act CLV of 1997 on consumer protection. In this case, we process your personal data as<\/p>\n\n\n\n

7. Data management related to newsletter subscription<\/strong><\/p>\n\n\n\n

The Data controller pays high attention to the legality of the use of the electronic mail addresses it<\/p>\n\n\n\n

manages, so he only uses them in the manner specified below to send (informational or advertising) e-<\/p>\n\n\n\n

mails.<\/p>\n\n\n\n

The Data controller does not perform automatic decision-making procedures and profiling with the<\/p>\n\n\n\n

11. Affected rights, legal remedies<\/strong><\/p>\n\n\n\n

The data subject may request information about the management of his personal data, as well as request<\/p>\n\n\n\n

the correction of his personal data, or – with the exception of mandatory data management – deletion,<\/p>\n\n\n\n

withdrawal, limitation of data management, and may exercise his right to data portability and protest at<\/p>\n\n\n\n

one of the contact details provided in section 1. of this Data Management Notice, or at customer service<\/p>\n\n\n\n

(e-mail address) as defined in section 6 of the Data Management Notice.<\/p>\n\n\n\n

Right to information:<\/strong><\/p>\n\n\n\n

You are entitled to contact the Data controller with a request for information on the processing of your<\/p>\n\n\n\n

the application and the number of applications, the 30-day deadline can be extended by another two<\/p>\n\n\n\n

months. The Data controller shall inform the Data subject of the extension of the deadline, indicating the<\/p>\n\n\n\n

reasons for the delay, within one month of receiving the request. If the Data subject submitted the request<\/p>\n\n\n\n

electronically, the Data controller will provide the information electronically, unless the Data subject<\/p>\n\n\n\n

requests otherwise. Information and measures are provided by the Data controller free of charge. If the<\/p>\n\n\n\n

Data subject’s request is clearly unfounded or – especially due to its repetitive nature – excessive, the Data<\/p>\n\n\n\n

controller may, taking into account the administrative costs associated with providing the requested<\/p>\n\n\n\n

The Data subject has the right to obtain from the Data controller feedback as to whether or not his<\/p>\n\n\n\n

personal data are being processed and, if such processing is taking place, the right to access the personal<\/p>\n\n\n\n

data and the following information: the purposes of the processing; the categories of personal data<\/p>\n\n\n\n

concerned; the recipients or categories of recipients to whom or with which the personal data have been<\/p>\n\n\n\n

or will be disclosed, including in particular recipients in third countries or international organisations; the<\/p>\n\n\n\n

envisaged period of storage of the personal data; the right to rectification, erasure or restriction of<\/p>\n\n\n\n

Data subject, with the exception of storage, submission, enforcement or defending legal claims, or to<\/p>\n\n\n\n

The Data controller informs all recipients of all corrections, deletions or data management restrictions<\/p>\n\n\n\n

carried out by him, to whom or to whom the personal data was disclosed, unless this proves to be<\/p>\n\n\n\n

impossible or requires a disproportionately large effort. At the request of the Data subject, the Data<\/p>\n\n\n\n
